Residence Permit for Academically Educated Skilled Workers in Germany

§18b of the Residence Act

Academically educated skilled workers in Germany who do not qualify for an EU Blue Card can still apply for a residence permit for academically educated skilled workers in Germany under §18b of the Residence Act. The most common reason for not getting a Blue Card is not meeting the minimum salary requirement.

Unlike some other visa types, the authorities do not have the freedom to decide regarding issuing the residence permit under §18b of the Residence Act on their own. If you meet all the legal requirements, they must issue the residence permit for academically educated skilled workers in Germany. This residence permit is usually granted for four years. However, if your employment contract is for a shorter period, the permit will be valid for the length of the contract plus an additional three months.

Our company, Nexus-Europe GmbH, assists foreigners with starting and developing their own business in Germany and moving to Germany through business immigration or the EU Blue Card. Over 20 years of operation we have helped more than 7,000 customers.

Eligibility for a Residence Permit for Academically Educated Skilled Workers in Germany

To qualify for the residence permit for academically educated skilled workers in Germany under §18b of the Residence Act, you must prove one of the following:

  • A German higher education degree
  • A foreign higher education degree that is officially recognized in Germany
  • A foreign degree that is considered essentially comparable to a German degree

The process for recognizing a foreign degree is the same as for the EU Blue Card.

You must also have a binding job offer or employment contract for a qualified occupation. A mere prospect of employment is not enough. Under German law, an occupation is considered qualified if it requires distinct skills, knowledge, and abilities that are typically gained through academic studies. Thanks to recent changes in the Skilled Workers Immigration Act, it is no longer necessary that your specific academic qualification must directly match the job you are applying for. This gives you more flexibility.

Additional Requirements for the Residence Permit for Academically Skilled Workers in Germany

Both you and your employer must confirm that you will actually work in the job described.

Your working conditions, especially your salary, must not be worse than those offered to German employees in similar positions.

If your profession requires a special practice permit (for example, in regulated professions like medicine or law), you must obtain that permit in advance.

Salary Requirement for Applicants Over 45

If you are applying for the first time for a residence permit for academically educated skilled workers in Germany and you are older than 45 at the time of application, a special salary rule applies. You must earn at least 55% of the annual contribution assessment ceiling for the German pension insurance scheme. In 2026, this means your annual salary must exceed approximately €55,770.

In extraordinary circumstances, this requirement may be waived, in particular if:

  • There is a public, regional, economic, or labor market policy interest
  • Your salary is only slightly below the threshold
  • Your age is only slightly above the limit

The residence permit for academically educated skilled workers in Germany offers a flexible and accessible pathway for foreign academics who want to work in Germany but do not meet the Blue Card salary threshold. With recent legal changes, it is now easier to match your degree with a broader range of qualified jobs, as long as the position genuinely requires academic-level skills.

And if you’d like to apply for a residence permit through business as a self-employed, our company, Nexus-Europe GmbH, provides turn-key solutions: from individual Roadmap development to establishing a fully operating business and moving to Germany through business immigration.
